1. Introduction

These Terms of Service (the “Terms”) define your legal rights and obligations relating to your access and use of https://tailor.wegeni.com and any related desktop, mobile, or software applications (collectively, the “App”) developed and operated by WeGeni IT Services and Consulting (OPC) Private Limited (“Geni Tailors”, “We”, “Us”, or “Our”).

By downloading, installing, or using the Site or App, you agree to be bound by these Terms, our Privacy Policy, and, where applicable, any End User License Agreement (EULA). If you do not agree to these Terms, please discontinue using the Services.

2. Definitions

“Services” refer to the tailoring ERP and POS modules provided by Geni Tailors, including Customer Management, Order Ticketing, Measurements Management, Billing & Payments, Delivery Tracking, Inventory Management, Staff and Expense Tracking, Notifications, and associated features.

“Content” means proprietary content made available by Geni Tailors in connection with the Services, including software, designs, UI elements, analytics, dashboards, reports, icons, and documentation.

“Your Content” or “User Content” means any data you upload or transmit through the Services, such as order details, measurement data, images, customer information, invoices, and configuration settings.

3. General Rules of Conduct

You are granted a personal, limited, non-exclusive, non-transferable license to use the Services strictly in accordance with these Terms.

You agree not to:

• 1. Use the App for any unlawful, fraudulent, or unauthorized purpose.
• 2. Copy, modify, reverse engineer, decompile, or distribute any part of the Services.
• 3. Attempt unauthorized access to our systems or integrations.
• 4. Upload viruses, malware, or harmful code.
• 5. Violate any applicable Indian or international laws while using the Services.

You agree to indemnify and hold harmless WeGeni from any claims, losses, damages, liabilities, or expenses arising from your violation of these Terms.

4. Intellectual Property Rights

You agree not to:

• 1. Use our name, logo, or branding without prior written permission.
• 2. Reproduce, resell, or commercially exploit any part of our software or designs.
• 3. Disclose or replicate our proprietary dashboard layouts or system architecture

By submitting User Content (e.g., tailoring data, measurements, or configuration settings), you grant us a perpetual, royalty-free, non-exclusive license to use such data solely to deliver, maintain, and improve our Services.

We do not claim ownership of your business or customer data.

5. Free Trial, Fees, and Subscriptions

• 1. We may offer a free trial of the Services for a limited period (typically 7 days).
• 2. Once the trial period ends, subscription charges apply as per your selected plan.
• 3. Paid Services are billed in advance—monthly or annually—via integrated payment gateways (UPI / Card / Net Banking).
• 4. No refunds are issued for partial use or early cancellation unless explicitly stated.
• 5. You can cancel your subscription anytime from your billing dashboard or by contacting support.
• 6. Pricing and plans may be revised with prior notice to active users.

6. Billing & Payments via Razorpay

Payments for subscriptions or other services offered through Geni Tailors are processed securely by Razorpay.

By completing a payment, you agree to Razorpay’s Terms of Service and Privacy Policy.

You are responsible for maintaining accurate payment information. Failed or unauthorized transactions may lead to suspension or termination of your account.

7. Privacy Policy

Your data is collected, processed, and protected in accordance with the Geni Tailors Privacy Policy.

By using our Services, you consent to the processing of your information as described in that policy.

8. Third-Party Services

Our platform may integrate third-party APIs or services, including but not limited to:

• 1. Payment gateways (e.g., Razorpay)
• 2. Analytics and performance tools
• 3. SMS / Email / WhatsApp providers
• 4. Cloud hosting and storage services

Your use of these integrations is governed by the respective third-party Terms and Privacy Policies.

WeGeni does not control or endorse third-party functionality and is not liable for their content, reliability, or security practices.

9. Disclaimer and Limitation of Liability

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law:

• A. WeGeni disclaims all warranties—express or implied—including merchantability, accuracy, and fitness for a particular purpose.
• B. We are not liable for:
• 1. Data loss due to system outages or user error.
• 2. Downtime caused by external service providers.
• 3. Incorrect setup or misuse of the system.
• 4. Business interruption, loss of profits, or damage to equipment.

In any case, WeGeni’s total liability shall not exceed the total fees paid by you in the three (3) months preceding the event giving rise to the claim.

10. Service Suspension and Termination

We reserve the right to suspend or permanently terminate your access to the Services:

• 1. For violation of these Terms
• 2. If required by law, court order, or government regulation
• 3. Due to technical, operational, or security issues
• 4. For non-payment after the grace period.

WeGeni shall not be responsible for any losses resulting from such suspension or termination.

11. Advertisers and Promotions

The App may display third-party advertisements or promotional offers. We do not endorse or guarantee these offers. Any dealings between you and such third parties are solely between you and them.

12. Changes to These Terms

We may modify or update these Terms at any time. Updates will be posted on https://tailor.wegeni.com and, where appropriate, notified via email or in-app messages.

Continued use of the Services after any update constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Namakkal District, Tamil Nadu, India.
